OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE'S CHANCES OF WINNING
1. SPONSOR: Walt Disney Internet Group, 500 South Buena Vista St., Burbank, CA 91521-6891 ("Mail Address"), is solely responsible for all aspects of this contest ("Contest").
2. BRIEF OVERVIEW OF CONTEST: This is a Contest to be conducted during the period commencing at 12:01 A.M, August 1, and ending at 11:59:59 P.M., September 12, 2008 ("Entry Period") as a competition to select four winning entries from among those Contestants submitting entries via http://family.go.com ("Website"). Contest submissions should consist of the following elements: [1] one (1) photo of a bad hairstyle or outfit, [2] title for the photo, [3] description of the photo not to exceed three thousand [3000] characters (collectively, "Submission"). For purposes of these Official Rules ("Rules"), "Day" shall mean each calendar day during the Entry Period and all times and Days are Pacific Daylight Time. The awarding of the prize is subject to the eligibility and forfeiture provisions set forth below.
3. ELIGIBILITY: To be eligible for this Contest, at the time of entering, the Contestant must be: [1] a natural person legally residing in, and physically located within, the 50 United States or the District of Columbia (collectively, "Territory"); [2] 18 or older; [3] a registered user of the Website in compliance with the Website's terms of use agreement ("TOU"); [4] not an employee, consultant, independent contractor or intern who has, within the past six months, performed services for Sponsor or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prize, or their respective parent, subsidiary, affiliated or successor companies (collectively, "Entities"), nor a member of their household or immediate family and [5] willing to have his/her Submission featured and published on the Website or otherwise distributed, in connection with, or to promote, the Contest and/or the Website. "Household members" shall mean people who share the same residence at least three months a year. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses.
4. ENTRY: During the Entry Period, you may enter the Contest by registering as a guest of the Website, clicking the link to the Mom, What Were You Thinking Contest, agreeing to the TOU, following the entry instructions to submit your Submission and clicking on the "submit" button ("Entry"). Only valid email addresses (individually, "Address") will be accepted for registration, as determined solely by the Sponsor. At Sponsor's sole discretion, a Contestant will be disqualified if he/she creates invalid Addresses with intent to affect the integrity of the voting process. Normal Internet access and usage charges imposed by your online service will apply. It is your sole responsibility to notify the Sponsor in writing if you change your Address. To do so, go to Website, log in, click on the "Modify" icon and follow the instructions on how to change your Address.
5. CONTEST MATERIALS: "Contest Materials" include: [1] all information and material submitted by you in connection with the Contest, including the Submission and all other forms, contracts or releases required to be submitted by you as a Contestant, whether required by Sponsor prior to or after Entry; [2] your name, voice, likeness, image and biographical data as contained in or reflected by the Submission and [3] all photographs, artwork, writings, statements, dramatic materials, ideas, quotations and any other intellectual properties created by you in connection with the Contest, whether submitted to the Sponsor or not, including the Submission. All material owned by the Sponsor or the Sponsor's affiliated companies, including but not limited to any picture, logo, title art, etc., shall remain their property and you shall acquire no rights therein by virtue of the Contest. Except as specifically provided herein, by entering the Contest, you agree to grant to Sponsor a non-exclusive, fully-paid, irrevocable, royalty-free, sublicenseable and transferable worldwide license to use, re-use, reproduce, transmit, display, distribute, re-distribute, copy, store, modify, adapt, translate, create derivative works based upon and publicly perform the contents of the Contest Materials, in whole or in part, in all media, formats and channels now known or hereafter devised, for the duration of the rights in each country, area and space, and throughout the universe, in perpetuity and in all languages, formats and versions. Upon Sponsor's request, you agree to assist the Sponsor in obtaining the consent for any other applications.
6. LIMITATIONS: By submitting the Contest Materials in the Contest, you represent and warrant to Sponsor that the Contest Materials and everything depicted therein: [1] do not originate from a magazine, newspaper or other commercial or proprietary source; [2] do not infringe upon or otherwise violate any right of any person, firm or entity; [3] comply with the TOU and the Rules; [4] do not contain any trademarks, logos, insignia, location signage, photographs, artwork or sculptures or other material (e.g., on props, costumes, background) that would infringe any third party's copyrights or trademarks; [5] have not previously been submitted in a contest of any kind or exhibited or displayed publicly through any means and [6] do not contain material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, national origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, harassing, defamatory, libelous, infringing or otherwise objectionable or unlawful as determined by Sponsor in its sole discretion. You further represent and warrant to Sponsor that: [1] you have all rights, licenses, permissions and consents necessary to submit the Contest Materials in the Contest in accordance with the Rules; [2] no person other than you, nor any entity, has any right, title or interest in and to any part of the Contest Materials and [3] you are not subject to any agreement or arrangement that would interfere with your entering this Contest and granting all the rights granted hereunder or that would conflict with any other documentation required hereunder. All Entries must be received during the Entry Period. Contestants may submit other Entries provided that each Entry embodies a different Submission. In event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the Address is registered. Entries by any method other than set forth above in Section 4 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, "Releasees") are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant's email account to receive email; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified. The Sponsor is not obligated to communicate with any Contestant during the duration of the Contest. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations. Please review these Rules and the TOU carefully; however, in the event of a conflict between the Rules and the TOU, the Rules will control.
7. PRIZES: ONE (1) GRAND PRIZE for the "Editor's Choice": one (1) prize package consisting of [1] 15-inch 2.5GHz Apple MacBook Pro, [2] Incase Neoprene Sleeve for 15-inch MacBook Pro, [3] JBL Radial High-Performance iPod Loudspeaker, [4] HP Photosmart C8180 All-in-One printer and [5] iPod nano (ARV:$3,611.85). One (1) FIRST PRIZE for the "Voter's Choice": One check in the amount of $1,000. (ARV:$1,000). Total ARV of all prizes: $4,611.85. Limit one prize per person/Address. First prize will be delivered to winners within sixty (60) days after selection of winners. Grand Prize is not transferable, except to a surviving spouse residing in the same household. First Prizes are not redeemable for cash or transferable. No substitution allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. All prizes will be awarded provided a sufficient number of eligible Entries are received and prizes validly claimed by November 12, 2008 after which no alternate winners will be selected, nor unclaimed prizes awarded.
8. PROCEDURES: On or about September 26, 2008, all eligible Entries received will be judged by the Sponsor, who will select one (1) Editor's Choice for the potential Grand Prize winner on the basis of the following judging criteria ("Criteria"): 60% for originality and 40% for relevance to subject of hair or outfit. During the Entry Period, the Website's registered visitors will be invited to vote on all eligible Entries received by applying the Criteria to determine the Voter's Choices for the potential First Prize winners. Entries will not be eligible for voting until the photo is pre-moderated and posted; therefore, there may be a slight lag time between when the photo is uploaded and it is posted and eligible for voting. Limit one vote per valid Address per Day for each Entry. If the Sponsor suspects invalid voting, including but not limited to, the use of script, macro or other automated or programmed methods of voting, or the setting up of an invalid Address or Addresses in order to create dummy usernames, with the intent to affect the integrity of the voting process, the perpetrators and beneficiaries will each be eliminated from the Contest, at Sponsor's sole discretion. The three Entries accumulating the most valid votes during the Entry Period, as determined solely by the Sponsor, will be the Voter's Choices for the potential First Prize winners.
9. WINNERS: The potential winners will be notified by email on or about September 29, and will be posted on the Website on or about October 10, 2008. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner's failure to respond to notification within seven (7) days after its mailing/transmission; [2] the return of an email notification as undeliverable after three (3) attempts; [3] the return of any other notice or a prize as undeliverable; [4] potential winner's failure to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the Address associated with the winning Entry; [5] potential Grand Prize winner's failure to execute and return an Affidavit of Eligibility/Liability/Publicity Release within fourteen (14) days after it is requested; [6] potential winner's failure to validly claim any prize by November 12, 2008 and [7] any other non-compliance with Rules. In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of each winner; and the Grand Prize winner will receive an IRS Form 1099 reflecting the $3,611.85 value of the Grand Prize.
10. PRIVACY POLICY/DATA COLLECTION: Information provided by you for this Contest is subject to Sponsor's privacy policy located at http://disney.go.com/corporate/privacy/pp_wdig.html
11. CONDITIONS: By entering this Contest, you agree, represent and warrant that: [1] you will be bound by the Rules and the Sponsor's decisions, which shall be final in all respects; [2] the Entry will not be acknowledged or returned; [3] you release and hold harmless the Releasees from any claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the Entry, selection or use of a Submission, or from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in any Contest-related activity or travel or from any interaction with, or downloading of, computer Contest information; [4] the Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Contest; [5] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor's reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Contest, so that it cannot be conducted as originally planned, the Sponsor, in its sole discretion, has the right to amend the Rules or cancel, modify, suspend or terminate the Contest; and in such event, to select winners by such method as Sponsor in its sole discretion shall consider equitable; [6] the Releasees are not responsible for typographical or other errors in the offer or administration of the Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [7] any portion of any prize not accepted or used by any winner will be forfeited; [8] the Releasees are not responsible for any inability of any winner to accept or use any prize (or any portion thereof) for any reason; [9] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) to be tampering or attempting to tamper with the Entry process or the operation of the Contest or the Website; (b) violating the Rules; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Contest property or service or (d) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or for any other good cause as determined solely by the Sponsor; [10] since any attempt by any individual to deliberately damage any Internet site or undermine the legitimate operation of the Contest is a violation of these Rules as well as criminal and civil laws; and should Sponsor believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution and [11] Sponsor has the right to modify prize award procedures at its sole discretion.
12. RULES & WINNER'S LIST: For names of winners (after October 10, 2008 and before November 12, 2008) and/or Rules (before September 12, 2008), send a self-addressed, stamped envelope to: Disney Family.com Mom, What Were You Thinking? Contest Tips & Guidelines
- If you need to scan your photo, scan in 300 dpi resolution.
- Select only the area you want to scan- don't select white space.
- If you do not have a scanner, you can find one at your public library, copy center, or local retail store with photo services.
- Center your photo as best as possible as we will need to crop the image to a square for the site.
- Upload a horizontal or vertical photo. If you crop the image yourself, make sure you keep a square form.
- For best results, make your image 400 pixels x 400 pixels at 72 dpi (or "save for web").
- Tell your friends and family about your entry and tell them to vote for you! Post a link to your entry on your social networking sites, blogs, etc.
